Refused? It can be overwhelming to learn that your application or visa to come to Canada has been refused. The importance of analysing what went wrong with your application as soon as possible is crucial in giving you a chance to making an informed next step.
A Canada immigration officer’s decision to refuse an application may be challenged if the decision was wrong in fact or in law, or if the decision is not in accordance with the principles of procedural fairness.
An in-depth consultation will provide you with a detailed analysis of the refusal decision. We will also advise you as to which solutions may be available to reverse the refusal decision.
We can help you with the following:
Reconsideration letters – If the refusal was based on an error in fact or in law, and/or if that decision was not in accordance with the principles of procedural fairness, we will prepare a letter to the Program Manager of the Canadian Visa Office to point out the errors and to request a reconsideration of the refusal decision.
Appeal – It certain instances, it may be an option to appeal your case to the Immigration Appeal Division (IAD), Federal Court of Canada, or the respective provincial court.
Resubmit application – If we consider both reconsideration letter or appeal is not the best option because of 1) low chances of success, 2) high cost, or 3) lengthy wait time, we may recommend resubmitting your application and tailoring it to address the immigration officer’s concerns and ensuring the submission is error free. This option is sometimes more effective than the above two options depending on the circumstances.
